CASE of ASSAULT AGAINST JOHNSON ATSELEGHE ADJOURNED TILL 22ND APRIL ,2022

The Evbuoriaria Magistrates’ Court 2  in Benin City on Friday adjourned the trial of the Iyasere of Warri Kingdom, Chief Johnson Atseleghe, over alleged assault on octogenarian, Madam Grace Tietie, to
22 of April, 2022.

At today's sitting,   the Prosecuting Counsel, Police  Prosecutor, N. A. Ukpebor closed his case. He told the court that the witnesses he was expecting to testify are no longer necessary as he has concluded his Case.

The defendant counsel, Pius Oiwoh told the court that he has no objection as the Prosecution has rounded up his Case.

They both agreed to take a date for the adoption of written addresses.

The Presiding Magistrate, Mr Festus Okoro thereafter adjourned the case until 22nd of April, 2022  for adoption of written addresses.

The defendant is being tried on a one count charge of assault on Grace Tietie, 84,  the Keke of Ologbo Dukedom in Ikpoba-okha Local Government Area of Edo state.

The defendant is charged for unlawfully assaulting Chief Grace Tietie by beating her up with fist blows and inflicted injuries on her head.

 The offence contravened Section 351 of the Criminal Code Cap 48 Vol.11 Laws of the defunct Bendel State of Nigeria, 1976, as applicable in Edo State.

If found guilty, Section 351 of the Criminal Code prescribes one year jail term for assault.

Meanwhile, the case between 
 the Enogie of Ologbo,  His Royal Highness, Prince Owenvbiugie Jason Akenzua ( claimant/ applicant), suing for himself and on behalf of the people of Ologbo Dukedom and Chief Johnson Atseleghe ( the Iyatsere of warri ), and 7 others have been adjourned to 22nd of May 2022.

The case with suit no: B/ 294/2020  before Justice Daniel Okungbowa of Benin High Court 2.

In the suit,  the action of the first defendant include  usurping, parading and exacting of parralel traditional powers and authority within Ologbo dukedom particularly Ologbo central, Ajatiton and Kolokolo, admistering and collection of administrative and development fee within Ologbo dukedom,  relating directly with companies and investors on community matters, collection of royalties and entitlements accruing to ologbo dukedom and the communities under it, also asserting control and ownership of communal lands within Ologbo dukedom  amongst other charges.

The Presiding Judge, Justice Daniel Okogbuwa adjourned the case to 19th of  May 2022 for continuous hearing.
