A Respondent/Vendor in the case of land grabbing brought before the Edo State Private Properties Protection Committee by Otunba Mike Aladenika, former Chairman of NUJ, Edo State Council has been directed to return the Petitioner's land to him.
The Respondent and vendor to the Petitioner, a staff of the University of Benin(name withheld) had sold the land in dispute to the Petitioner, Otunba Aladenika and subsequently the land was transferred by the community to another party.
During the Committee's hearing on the matter on Friday, March 3, the vendor was directed by the Committee to return the Petitioner's land the way it was encroached on and subsequently sold to another Respondent, one Uche, making it the second time the Petitioner's land was seized.
The Committee expressed dissatisfaction with the Vendor's failure to produce all the parties involved with him in the dispute, describing his attitude as lacklustre.
The Ohen of Okhuoromi, a main Respondent in the case, and the said Uche who had developed structures on the said land, were both said to be at large, leaving the vendor to his fate.
The Respondent/Vendor had pleaded with Otunba Aladenika to accept the land he was proposing to give to him as replacement for the one that was grabbed by the community and sold to the said Uche, pleading that he could not afford the sum of #11m which the Petitioner was asking for his land.
Meanwhile, Otunba Aladenika said he would only accept the land being proposed by the Respondent if the vendor would erect the twin 3 bedroom flats he had built at DPC level on the new land before handing it over to him.
The Respondent agreed to look at the possibility of raising money to put up the structures and handing the land over to the Petitioner, Otunba Aladenika.
The Edo State Private Properties Protection Committee told the Respondent to hasten up in the arrangements with his friends and all those involved in the sale of the Petitioner's land and do as the Petitioner had requested.
Hon. Justice Alero Edodo-Eruaga(Rtd), Chairman of the Committee also informed the parties that a Resolution will be drawn and taken to the Multidoor Court in order to seal the terms of agreement and make it legally binding.
The Hon. Justice however advised Otunba Mike Aladenika to ensure to do a search on the proposed land and when it is free of any encumbrances, carry out a survey and proceed to get a Certificate of Occupancy after all the agreements have been sealed at the
Multidoor Court.
The case was adjourned to May 4th when report will be heard from the parties on the decisions taken.
The Committee also reached landmark resolutions on several of the 27 cases heard during the day's sitting.
